Revised Act 6 / Act 91 Notice – Are You In Compliance? 

Effective April 30, 2016, the Pennsylvania Housing Finance Agency (PHFA) revised the Act 6 / Act 91 notice that is required for Pennsylvania residential foreclosures.  The notice is used for the Homeowner’s Emergency Mortgage Assistance Program (HEMAP).  Revisions were made to provide a more accessible program for consumers.

Banks were required to implement the revised notice no later than September 1, 2016.  Failure to implement the revised notice may result in presumption of deficiency under state law and challenges to the validity of the foreclosure action.  PHFA will monitor for compliance with the revised notification requirements.  An example copy of the revised notice is available for download in PDF format via the PHFA website: www.phfa.org
